How the notice period is calculated in India

The notice period is the gap between the day you resign (or are served notice) and your last working day. Indian appointment letters usually fix it at 30, 60 or 90 days for confirmed employees and 7 to 15 days during probation. The date maths looks simple, but four small conventions change the answer by several days, and every one of them is set by the employer's policy rather than by law.

Last working day = Notice start date + Notice days, minus 1 (if the start date counts as day 1) + Leave days taken during notice
Latest resignation date = Joining date, minus 1 day (last working day), minus Notice days (adjusted for the start convention)

The four conventions that move your date

1. Calendar days vs working days

Almost every Indian employer counts calendar days, so Saturdays, Sundays and public holidays sit inside the 30, 60 or 90 days and do not push the date out. A few contracts (mostly consulting and some MNC policies) count working days, which makes a "30 day" notice stretch to about six weeks.

2. Day 1 is the next day

Most HRMS tools (and the standard HR practice) start the notice on the day after the resignation is submitted or accepted. Resign on 1 October with 30 days of notice and the last working day is 31 October. If your employer counts the resignation day itself, the answer is 30 October.

3. Leave during notice

Policies commonly say that leave taken during notice extends the last working day by the same number of days, so that the full notice is served. Casual leave is often not allowed at all, and earned leave is usually encashed in the full and final settlement instead of being availed.

4. Weekend endings

When the calendar end date lands on a Saturday or Sunday, many companies make the previous working day your last day in the office and still show the calendar date as the relieving date. Others let you serve through the weekend on paper. The calculator flags this so you can confirm with HR.

Worked example

Priya resigns on Thursday, 1 October 2026 with a 60 day calendar notice. Her notice starts on 2 October, so day 60 falls on Monday, 30 November 2026. Her new employer wants her on Tuesday, 17 November, which means her last working day needs to be 16 November. She has 14 days of shortfall (17 November to 30 November). At a gross salary of Rs 90,000 a month, the usual buyout estimate is 90,000 / 30 x 14 = Rs 42,000, recovered in her full and final settlement unless the new employer reimburses it. If she also took 3 days of leave in the first month and her policy extends the notice, her last working day moves to Thursday, 3 December and the shortfall grows to 17 days.

What the law says about notice periods

There is no single statutory notice period in India. Your contract governs, within the floors set by these laws for termination by the employer:

Two things follow from this. First, the state minimums apply to termination by the employer; the notice an employee must give is mostly a contractual term, though Delhi, West Bengal and Haryana also fix an employee side notice. Second, no law prescribes a 90 day notice. Long notice periods are a contractual choice, and courts have held that an employee cannot be forced to keep working, so the practical remedy for an unserved notice is recovery of notice pay, not an injunction.

Tips before you submit the resignation

Put the resignation in writing (email counts) and keep the acknowledgement, because the notice clock usually starts from the date it is received or accepted. Ask HR in the same email to confirm your last working day in writing, whether leave during notice extends it, and whether a buyout or waiver is possible. If you have a joining date, run the "When should I resign?" mode first and add a buffer of two or three days for approvals. Finally, do not join the new employer before the relieving date; a missing relieving letter is the most common reason a background verification fails.
